Terms and Conditions

General Terms

  1. Definitions:
    1.1. “Gym” refers to Reform Fitness Headquarters located at 131, Triq il-Wied, L-Imsida, Malta.
    1.2. “Facility/Facilities” refers to the Gym including the gym area, locker room, changing rooms and showers and toilets and all equipment at the Gym.
    1.3. “Member/s” refers to the person named in the Membership Form.
    1.4. “Membership” refers to the membership to the Gym in accordance with the Terms and Conditions, policies and guidelines set out herein and which may come into force from time to time.
    1.5. “Terms and Conditions” refers to the terms and conditions outlined below including the General Terms, Health and Safety Terms, Gym Terms, Booking System Instructions which may be changed from time to time and any other policies, procedures, guidelines and instructions which may come into force from time to time.
  2. The Gym provides personal training sessions, group fitness classes and the provision of gym amenities.
  3. Members are subject to the Terms and Conditions, policies, instructions and guidelines outlined herein and as may be amended by the Gym from time to time.
  4. The Members shall make use of the Gym amenities, attend group fitness classes, and take part in personal training sessions as well as make use of the Gym Facilities.

By signing the membership form, the Member acknowledges and agrees to adhere to all Terms and Conditions set forth herein, as well as Gym policies, procedures, instructions, and guidelines outlined below or which may come into force from time to time.

Health and Safety Terms

  1. Medical Clearance: All Members must complete a medical clearance form before beginning any exercise program. If necessary the Member shall consult with their physician before starting any new fitness regimen. This medical clearance form includes the completion of the Physical Activity Readiness Questionnaire (“PAR-Q”). Members must fill in this PAR-Q and depending on the outcome of the PAR-Q, the Member shall obtain further clearance from a medical doctor or specialist.
  2. Assumption of Risk: By signing the membership form, the Member acknowledges that participation in physical exercise involves inherent risks and agree to assume all responsibility for any injuries or damages which may occur as a result of such activities. The Member agrees and undertakes that they shall use the Gym and its Facilities at their own risk and the Gym, its management, and staff shall under no circumstances be liable for any loss, personal injury, death or damage sustained by the Member within the Gym and its Facilities. The Member further acknowledges and agrees to unconditionally release the Gym, its management and staff from any and all liability.

Gym Terms

  1. Towel Usage: Members are required to use a towel on each machine. This is to maintain hygiene and comfort for all users. Members should wipe their feet before entering the Gym.
  2. Sanitisation: All equipment must be sanitised after each use. Sanitising wipes and sprays are provided throughout the Facility.
  3. Personal Belongings: No personal belongings are allowed in the gym area except for locker keys, water bottles, towels, and headphones. Lockers are available for storing personal items. Personal belongings are the responsibility of the Members therefore, the Gym, the management or any of its staff are not responsible for any lost, stolen, or damaged personal belongings.
  4. Session Timing: Each session is 1 hour long. Members can access the Gym 10 minutes prior to their booked time and must vacate the premises within 15 minutes after their session ends to allow space for the next client.
  5. Locker Room Etiquette: No photos are allowed in the locker rooms to respect the privacy of all Members. The locker will be provided to the Member during their session time. Members shall empty and clear the locker assigned to them from any personal belongings, and return the locker key after their session ends. All lockers will be checked by the management at the end of each day. Any personal belongings found will be removed by the management. Items found and not claimed within 3 days will be disposed of. Locker keys remain the property of the Gym and must not be taken outside the Gym premises. The Gym does not undertake that use of a locker will guarantee that no theft of or damage to personal belongings will occur. The Gym will not accept any liability in relation to locker thefts.
  6. Time Management: Members should avoid time-wasting behaviours. Efficient and focused training is encouraged.
  7. Weight Handling: No slamming of weights is permitted. Proper handling and placement of weights is required.
  8. Noise Levels: Grunting is allowed to a certain degree. Excessive noise that disturbs other Members is not tolerated.
  9. Dress Code: Proper gym attire is mandatory. Shirtless training, extremely revealing clothing, and improper footwear such as flip-flops or open toed shoes are not allowed. Members must wear proper gym shoes.
  10. Facility Use: Reform Fitness Headquarters is a training facility, not a social club. Members should respect their allocated times. The Gym may withdraw use of part of the Facilities at the Gym due to failure of services or for maintenance or repair. Compensation will not be given for such closures. The management and staff have the right to restrict access to any Member who is deemed or considered to be unsafe to other members within the Gym.
  11. Membership Termination: The management reserves the right to end any membership without prior notice if deemed necessary and without any refund.
  12. Equipment Care: Members are expected to take care of the equipment as they will be using it again next time.
  13. Equipment and Facility Use: The Facilities and equipment shall be used by the Members in the way it is intended to be used. Members shall also abide with the advice provided by the management, staff, and personal trainers of the Gym. The management and staff of the Gym will assist the Members with their queries regarding use of Facilities and equipment.
  14. Damages: Members shall pay for any damages they incur to the equipment or Facility of the Gym, resulting from any wrongdoing and negligence of the Member, and/or non-observance to the advice provided by the management, staff, and personal trainers of the Gym.
  15. Age: Members shall be at least 14 years of age. However, any Member between the age of 14 and 17 years of age must be supervised by an adult or by a personal trainer at all times while at the Gym and its Facilities. In this case, Membership shall be accepted provided that Members under the age of 18 years of age, provide parental consent.
  16. Children: Children under the age of 3 are not permitted at the Gym. Children over the age of 3 must be attended by an adult at all times. If Children over the age of 3 will be attending the Gym, the Gym management must be notified beforehand. The Gym management reserves the right to accept or decline the attendance of children at the Gym based on safety, capacity, or other relevant considerations.
  17. Cancellations: If a Member attending fitness classes and/or personal training sessions need to cancel their session, they should do so at least 24 hours prior to their scheduled session.
  18. Consent to Images/Videos: By signing the membership form, the Member agrees and expressly consents to the Gym and its management to publish and use any images and/or videos in any of its publications, websites, and social media platforms and materials for distribution, taken by the Gym of the Gym/Facilities which the Member may appear in, unless the Member expressly opts out by providing written notice to the Gym’s management. By signing the membership form, the Member also expressly consents to the Gym and its management to use and publish the Member’s images and/or videos in any of its publications, websites, and social media platforms and materials for distribution. The Member acknowledges that upon the publication of this data and media on the internet, the Gym and its management shall have no further control over its subsequent use and disclosure.
  19. Marketing/Promotional/Commercial Activity: Members or third parties are not permitted to engage in any marketing, promotional, or commercial activity within the Gym unless they have obtained prior written consent from the management of the Gym.
  20. Memberships: The Gym offers different membership packages including Gym membership packages, personal training membership packages, and fitness classes membership packages. The Membership may be used during the Gym opening hours excluding Sundays and Public Holidays. The Membership may be only used by the Member and cannot be loaned to anyone else.

    20.1. Gym Membership Package: Gym membership packages may be purchased for a:
    • 1 day pass – To be used on the date of purchase.
    • 1 month pass – Valid for one month from the date of purchase.
    • 3 month pass – Valid for three months from the date of purchase.
    • 6 month pass – Valid for six months from the date of purchase.
    • 1 year pass – Valid for one year from the date of purchase.
    20.2. Personal Training Membership Package: Personal training membership packages may be purchased for:
    • 1 session – To be used on the booked date.
    • 5 sessions – To be used within 30 days from date of purchase.
    • 10 sessions – To be used within 60 days from date of purchase.
    • 15 sessions – To be used within 90 days from date of purchase.
    • 20 sessions – To be used within 120 days from date of purchase.
    Any classes not used within the expiry date will automatically be lost.

    20.3. Fitness Classes Membership Package: Fitness classes membership packages may be purchased for:
    • 1 class – To be used on the booked date.
    • 5 classes – To be used within 30 days from date of purchase.
    • 10 classes – To be used within 60 days from date of purchase.
    • 15 classes – To be used within 90 days from date of purchase.
    • 20 classes – To be used within 120 days from date of purchase.
    Any classes not used within the expiry date will automatically be lost.

  21. Data Protection Policy: Members’ personal data will be processed in accordance to the Gym’s Data Protection Policy which is available on the Gym’s website.

Booking System Instructions

  1. Booking Requirement: Members must book prior to coming to the Gym. Walk-ins are not allowed.
  2. Types of Bookings:
    • ‘Book Now’ Booking: Members log in and commit to arrive within the next 20 minutes. If the Member does not arrive at the Gym within 20 minutes, the booking will be automatically cancelled and the process must be repeated.
    • Pre-Booking: Members may book one preset time per day (e.g., 17:00). Members must arrive exactly at the booked time. If not, the booking will be cancelled and Members must revert to the ‘Come Now’ option.
  3. Booking Policies:
    • First Come, First Served: The ‘Book Now’’booking is on a first come, first served basis.
    • Gym Capacity: The Gym has a maximum capacity of 15 people at any time.
    • Boost Session: Each Member with an active Membership can extend one session per week by an additional 30 minutes while at the Gym.
    • Double Session: Each Member with an active Membership can book a double session once a week.
  4. Session Duration:
    • Upon entering the premises, Members have 10 minutes to change or get ready before the active 1-hour session starts.
    • After the 1-hour session elapses, Members have 15 minutes to vacate the premises, providing time for a shower and change.
    • Alternatively, members may use both the initial 10 minutes and the final 15 minutes for working out, as long as they vacate the premises after the allocated 1-hour and 25 minutes.

Final Provisions

  1. The Gym reserves the right to modify these Terms and Conditions in whole or in part, at any time. Members shall receive an email with the updated Terms and Conditions.
  2. If any part of these Terms and Conditions is deemed unlawful, void or for any reason unenforceable, then that part shall be deemed severable from these Terms and Conditions and shall not affect the validity and enforceability of any remaining provisions of these Terms and Conditions.
  3. These Terms and Conditions are governed and construed and enforced in accordance with the laws of the Malta and any disputes will be solved before the competent Maltese courts.

By becoming a Member and signing the membership form, the member confirms that s/he have read, understood, and agree to abode by the Terms and Conditions including General Terms, Health and Safety Terms, Gym Terms, and Booking System Instructions outlined above and to any other policies, instructions and guidelines which may come into force from time to time. The Member acknowledges that failure to adhere to these Terms and Conditions, policies and instructions may result in termination of their Membership.

By becoming a Member and signing the membership form, the Member also hereby acknowledges that s/he have completed a medical clearance form, filled in truthfully and to the best of their knowledge the PAR-Q and have consulted with their doctor regarding their intention to begin an exercise program. The Member confirms that s/he is in good health and they acknowledge that s/he is responsible for their own health and well-being during any exercise and while using the Gym amenities.

Privacy Policy

Effective date: October 23, 2024

1. Purpose

The purpose of this Privacy Policy is to inform Members how their information is being collected, used and stored by Reform Fitness Headquarters. Reform Fitness Headquarters is dedicated to protect the privacy and protection of data of Members and information disclosed to Reform Fitness Headquarters.

Data is collected and processed in an appropriate and lawful manner and in accordance with the GDPR (Regulation (EU) 2016/679) and Data Protection Act (Cap. 586 of the Laws of Malta).

2. Definitions

2.1. “Personal Data” means any information relating to an identified or identifiable natural person (“Data Subject”). This can be a name, an identification number, location data, online identifier, one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person. (“identifiers”).

2.2. “Data Subject” means identified or identifiable natural person. An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier. In this policy the Data Subject may also be referred to as the “Member”/”You”/”Your”.

2.3. “Data Controller” means the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of Personal Data. In this policy the Data Controller is “Reform Fitness Headquarters” which may also be referred to as “Reform Fitness Headquarters”/”We”/”Our”/”Us”.

2.4. “Processing” means any operation or set of operations which is performed on Personal Data or on sets of Personal Data, whether or not by automated means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

2.5. “Services” refers to the gym services provided by Reform Fitness Headquarters.

2.6. “Reform Fitness Headquarters” refers to the gym located at 131, Triq il-Wied, L-Imsida, Malta. The gym is owned by Mr. Jeffrey Montebello.

2.7. “Member/s” refers to the person named in the Membership Form.

2.8. “Website” refers to reformfitnesshq.mt.

3. Which Personal Data is Collected

Reform Fitness Headquarters collects, uses, and stores different kinds of Personal Data about You. This Personal Data collected, used and stored by Reform Fitness Headquarters includes (but not limited to):

  1. Identity Data: first name, last name, and date of birth;
  2. Contact Data: postal address, contact number, and email address;
  3. Certain health information: this is processed for the Data Subject’s interest (when We advise You on a fitness programme and/or in case of a medical emergency) and/or where specific consent has been provided;
  4. Communications exchanged with Reform Fitness Headquarters and You.

By providing Reform Fitness Headquarters with this information, You consent to the collection, storage and use of that information subject to the terms of this Privacy Policy.

If You withhold Your personal information, it may not be possible for Reform Fitness Headquarters to interact or engage in business with You and/or to provide its Services to You.

This Personal Data is processed by Reform Fitness Headquarters at its operating offices and in any other place where the parties involved in processing are located. This means that this information may be transferred to and maintained on computers located outside the Data Subject’s country. Personal Data is stored electronically as well as physically.

Reform Fitness Headquarters is committed to ensure that the personal information You provide is secured hence, the necessary procedures are in place to safeguard and secure information, to prevent unauthorized access or disclosure and to protect it from misuse, interference, and loss.

4. How is Personal Data Collected

Reform Fitness Headquarters may collect Your Personal Data through:

  1. Our membership forms;
  2. b. Our Website;
  3. c. Documents and/or information provided by the Data Subjects themselves.

5. Why is Personal Data Collected

Reform Fitness Headquarters collects only the data that is necessary, and keeps the data up to date and only for as long as it is needed. Personal Data is retained for as long as necessary to fulfill the purpose it was collected for, including for the purpose of satisfying any accounting, legal, or reporting requirements.

The appropriate retention period is determined by the nature, amount and sensitivity of the Personal Data, the purposes for which the Personal Data is processed, whether Reform Fitness Headquarters can achieve those purposes through other means, the potential risk of harm from unauthorized use or disclosure and the applicable legal requirements.

Reform Fitness Headquarters may use this data for the following purposes:

  1. To provide and maintain its Services;
  2. To enter into an agreement with You and to be able to perform the agreement with You;
  3. To maintain customer record keeping;
  4. To communicate with You;
  5. To provide You with information about products and Services;

Reform Fitness Headquarters may disclose Your Personal Data to any employees and officers of Reform Fitness Headquarters insofar as reasonably necessary for the purposes set out in this Policy.

Reform Fitness Headquarters may share Your Personal Data with the following third-parties:

  1. Service Providers/Subcontractors/Third parties - Personal Data may be shared with Service Providers/Subcontractors/Third party who assist in the running of the business;
  2. Authorities - Personal Data may be shared with authorities for the provision of certain services;
  3. Law Enforcement - under certain circumstances, Reform Fitness Headquarters may be required to disclose Personal Data of Data Subjects if required to do so by law or in response to valid requirements by public authorities.

Reform Fitness Headquarters may disclose Your Personal Data in good faith believing that such action is necessary to:

  1. Comply with a legal obligation;
  2. Protect and defend the rights or property of Reform Fitness Headquarters;
  3. Prevent or investigate possible wrongdoing in connection with the Service;

You have the right to make a complaint to the Information and Data Protection Commissioner (“IDPC”) as the supervisory authority for data protection issues. However, it would be appreciated if any complaints are dealt with Reform Fitness Headquarters prior to approaching IDPC.

8. Direct Marketing

Reform Fitness Headquarters may use Your Personal Data to deliver direct marketing communications to You about their products and services and any other products or services You might be interested in. You may notify Reform Fitness Headquarters if You do not want to receive these communications. Once Reform Fitness Headquarters receives this notification, it will comply with Your request and will not use Your Personal Data for such purposes.

We have no control over and assume no responsibility for the content, privacy policies or practices of any third party sites or services.

9.8. Children’s Privacy

Our Website does not address anyone under the age of eighteen (18) (“Children”).

We do not knowingly collect personally identifiable information from anyone under the age of eighteen (18). If You are a parent or guardian and You are aware that Your children have provided Us with Personal Data, please contact us. If We become aware that We have collected Personal Data from children without verification of parental consent, We take steps to remove that information from Our servers.

Booking System Instructions:

  1. You must book your gym time before coming to the gym. This means you cannot just show up without booking a spot first.
  2. Types of Bookings:

      • This is for members who want to come to the gym right away.
      • How to Book:
        1. Log into your account online.
        2. Select ‘GYM - 60min’ service.
        3. You will see if there is a spot open in the gym right now.
        4. If there is an open spot, you can book it by pressing ‘ADD’ and then ‘BOOK’ You will have 20 minutes to confirm the booking.
        5. If the gym is full, the system will tell you the next five available times you can book.
        6. If you book a spot but don’t show up within 20 minutes, your booking will be automatically cancelled.
    • B. Book For Later
      • This is for members who want to plan their gym time ahead.
      • How to Book:
        1. Log into your account online.
        2. Select ‘GYM - 60min’ service.
        3. Select ‘BOOK For LATER’ from the drop down menu.
        4. Pick a time you want to come to the gym, like 17:00. Press ‘ADD’ followed by ‘BOOK’ to confirm booking.
        5. Make sure you arrive at the gym exactly at the time you booked.
        6. If you are late or miss your time, your booking will be cancelled. You must then revert to the ‘BOOK NOW’ Option.
  3. Booking Policies:
    • First Come, First Served: The ‘Come Now’ booking is on a first come, first served basis.
    • Gym Capacity: The gym has a maximum capacity of 15 people at any time.
    • Boost Session: Each member with an active membership can extend one session per week by an additional 30 minutes while at the gym.
    • Double Session: Each member with an active membership can book a double session once a week.
  4. Session Duration:
    • Upon entering the premises, members have 10 minutes to change or get ready before the active 1-hour session starts.
    • After the 1-hour session elapses, members have 15 minutes to vacate the premises, providing time for a shower and change.
    • Alternatively, members may use both the initial 10 minutes and the final 15 minutes for working out, as long as they vacate the premises after the allocated 1 hour and 25 minutes.

Gym Policies and Member Agreement:

  1. Towel Usage: Members are required to use a towel on each machine. This is to maintain hygiene and comfort for all users. Members should wipe their feet before entering the premises.
  2. Sanitisation: All equipment must be sanitised after each use. Sanitising wipes and sprays are provided throughout the facility.
  3. Personal Belongings: No personal belongings are allowed in the gym area except for locker keys, water bottles, towels, and headphones. Lockers are available for storing personal items.
  4. Session Timing: Each session is 1 hour long. Members can access the gym 10 minutes prior to their booked time and must vacate the premises within 15 minutes after their session ends to allow space for the next client.
  5. Locker Room Etiquette: No photos are allowed in the locker rooms to respect the privacy of all members.
  6. Time Management: Members should avoid time-wasting behaviours. Efficient and focused training is encouraged.
  7. Weight Handling: No slamming of weights is permitted. Proper handling and placement of weights are required.
  8. Noise Levels: Grunting is allowed to a certain degree. Excessive noise that disturbs other members is not tolerated.
  9. Dress Code: Proper gym attire is mandatory. Shirtless training, extremely revealing clothing, and improper footwear such as flip-flops are not allowed. Members must wear proper gym shoes.
  10. Facility Use: Reform Fitness Headquarters is a training facility, not a social club. Members should respect their allocated times.
  11. Membership Termination: The management reserves the right to end any membership without prior notice if deemed necessary.
  12. Equipment Care: Members are expected to take care of the equipment as they will be using it again next time.
